Motion for Sale of Property under Section 363(b)

  1. Click Bankruptcy Menu
  2. Click Motions/Applications
  3. Enter the case number.

    **When following the steps below, click the Next button to navigate to the next screen.

  4. Select Sale of Property under Section 363(b) (Motion) from the event list.
  5. At the Select the Party screen, select the party you represent. If the party is not listed, click on Add/Create New Party.
  6. The attorney association screen will appear if the attorney/party association does not yet exist. The check box is preselected.
  7. On the screen "Is this Motion being Filed for Selling Property Free and Clear of Liens Under Section 363(f)?"select Yes or No.
    • Select No if the Motion is under Section 363(b).
    • If the motion being filed is for selling property free and clear of liens under Section 363(f), do not continue to docket this event. Use the event Sell Property Free and Clear of Liens under Section 363(f) (Motion).
  8. Browse, verify and attach the document.
  9. The screen "Note:When filing the Notice for this Motion, use the event:Use, Sale or Lease of Property Under Section 363(b) (Notice of Proposed) under the Notices menu."
  10. Docket Text:Modify as Appropriate.
  11. Review final docket text.
