Public Comment Period - Proposed Local Rules Changes
The amendments to the Federal Rules of Bankruptcy Procedure, which will go into effect on December 1, 2017, necessitate additional revisions to New Mexico Local Bankruptcy Rule 3015-2 regarding the Chapter 13 Plan and Confirmation. In addition, a new rule to assist the United States trustee in reviewing fee applications (Rule 2016-1) has been proposed. The Notice of Proposed Amendments to New Mexico Local Bankruptcy Rules describing the proposed amendments filed September 22, 2017, can be found on the Court’s website at http:\\nmb.uscourts.gov/court-info/local-rules-and-orders.
A redlined copy of the proposed additional amendment to NM LBR 3015-2 and new proposed NM LBR 2016-1 is now posted to the Court’s website (http:\\nmb.uscourts.gov/court-info/local-rules-and-orders) for public comment. The deadline to submit comments is Monday, October 30, 2017. Comments may be submitted to the Court by email: web_ntp@nmcourt.fed.us. Or, written comments may be sent by mail to the United States Bankruptcy Court, Attn: Local Rule Comments, P.O. Box. 546, Albuquerque, New Mexico. All comments will remain anonymous to the judges and chambers staff.
The Court anticipates that the amendments to the New Mexico Local Bankruptcy Rules previously published for notice and comment In April 2017 (including the mandatory local form Chapter 13 Plan), together with these proposed additional amendments, will become effective on December 1, 2017, to coincide with the effective date of the amendments to the Federal Rules of Bankruptcy Procedure.
