Official Form 423, Certification About a Financial Management Course

As part of the Forms Modernization Project, Form 423 replaces former Official Form 23, Debtor’s Certification of Completion of Postpetition Instructional Course Concerning Personal Financial Management. The Court has previously recommended use of a local form, NM OF 23.
Debtors sign Form 423 to certify that the personal financial management post-petition course has been completed. The date and certificate number from the course is entered on the form. Prior to December 1, the Court has allowed attorneys to file only the certificate of completion of a course in personal financial managementrather than the certification form by itself.
Beginning December 1, 2015, debtors MUST file Official Form 423, certify completion of the course by filling out the date and certificate number, and sign the form. The certificate is NOT required to be attached. If there is a joint debtor for the case, two forms must be filed – one for each debtor. New Mexico local form 23 will no longer exist when Official Form 423 becomes effective.
